Terms and Conditions

These terms and conditions (the “Terms and Conditions”) are the terms and conditions upon which Blossom Atelier (“we/us”) makes available to you and any of our services which are accessible on or via the Blossom Atelier website.

These Terms and Conditions govern your use of the Blossom Atelier Site and the Blossom Atelier Service.

  1. Blossom Atelier Products

1.1 All Blossom Atelier Products as depicted on this website (as may be varied from time to time) are available in Edinburgh within the following postcodes only EH1 – EH17. We are sorry that at this moment in time we are unable to accept orders outwith the areas outlined above.

1.2 All Blossom Atelier Products are subject to availability. In the event of any supply difficulties, we reserve the right to substitute a Blossom Atelier Product of equivalent value and quality without notice.

1.3 In the event that we are unable to supply the Blossom Atelier Product or any substitute product to you at all, we shall notify you as soon as is reasonably possible and shall reimburse your payment in full and in any event no later than 30 days after the intended delivery date.

  1. Prices

2.1 Prices listed within the Blossom Atelier Service are valid for a maximum of 14 days of submitting your purchase form.

2.2. Prices include local Edinburgh delivery within the following postcodes only EH1 – EH17. We are sorry that at this moment in time we are unable to accept orders outwith the areas outlined above.

  1. Orders/Payment

3.1 You will be given clear instructions to follow to navigate the Order Form and you shall be required to provide us with your complete personal details, including accurate postcode, together with those of the intended recipient and all necessary payment details. We accept payment by all major credit and/or debit cards other than Solo, Electron, department store cards and any other credit and/or debit cards as we may specify from time to time. By clicking on the ‘Proceed’ button on the Order Form, you are consenting to be bound by our terms and conditions contained in these Terms and Conditions and appearing anywhere on the Blossom Atelier site.

3.2 We take all reasonable precautions to keep your order and payment details secure, but, in the absence of negligence on our part, we cannot be held responsible for any losses incurred by you as a result of unauthorised access to the information which you have provided to us.

3.3 You confirm that the credit or debit card with which you make payment is held validly in your name. We cannot be held liable for any delays or non-delivery which may occur if credit or debit card provider does not authorise payment. You should also ensure that any information supplied by you is correct before proceeding to payment. We do not accept responsibility or offer refunds if you provide incorrect information.

3.4 We cannot accept Order Forms from customers under the age of eighteen (18) years.

3.5 Cancellation of orders need to be made in writing to [email protected]  and will be subject to 20% Handling Fee.

  1. Refunds

4.1 In the event that there is an issue with your product, please contact us immediately at [email protected] with evidence that shows the issue, and we will work to correct the problem.

  1. Delivery

5.1 Incorrect personal details may lead to problems or delays in delivery, so before placing your order, please ensure that you have included the full address details, including accurate postcode of the intended recipient and your daytime contact telephone number or e-mail address so that we can notify you in the event that any delivery problems are encountered.

5.2 In case of delivery to certain locations where a third party is involved, such as hospitals, airports, hotels and ships, the signature of any person authorised to accept delivery on behalf of the organisation shall be accepted as proof of delivery to your chosen recipient.

  1. Blossom Atelier Customer Services

6.1 In the event that you are not satisfied with the Service any complaints should be addressed in writing to: [email protected]

6.2 Because of the perishable nature of Blossom Atelier Products and in order to assist us in resolving any complaints quickly and to our mutual satisfaction, we advise you to make any complaint within 1 working day of the date of delivery or intended delivery of your purchase.

  1. Disclaimer

7.1 Whilst we agree to use our reasonable endeavours to ensure that the Blossom Atelier Site and/or the Blossom Atelier Service is fully operational and error-free we cannot guarantee this and, therefore, accept no responsibility for any defects and/or interruption of the Blossom Atelier Site and/or the Blossom Atelier Service and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of the Blossom Atelier Site and/or the Blossom Atelier Service impossible or impractical.

  1. General

8.1 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Blossom Atelier Site and/or the Blossom Atelier Service from time to time. We will post any changes on the Blossom Atelier Site and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Blossom Atelier Service or Blossom Atelier Site. Changes will be effective five (5) hours after the posting of any such change and all subsequent dealings between you and us shall be on the new terms and conditions.

8.2 Additionally, we reserve the right to suspend, restrict or terminate access to the Blossom Atelier Site and/or the Blossom Atelier Services for any reason at any time.

8.3 We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions and as stated in our Privacy Policy and Data Protection Statement.

8.4 A person who is not a party to the agreement between you and us has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists apart from that Act.

8.5 Save in respect of fraudulent misrepresentation, this agreement (including any documents and instruments referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof.

8.6 Your purchase will be deemed to have occurred in the UK. These Terms and Conditions shall be governed by and construed in accordance with Scottish Law and the parties agree to submit to the exclusive jurisdiction of the Scottish Courts.

  1. Liability

9.1 Our total liability to you or to any third party whether in contract, delict (including negligence), misrepresentation or otherwise, arising as a direct consequence of your (or any third party’s) use of the Products (including, without limitation, loss of business, costs or expenses) will be limited to the price of your Order.

9.2 We shall not be liable for any indirect or consequential loss or damage (including loss of profit, loss of business or otherwise), costs, expenses or other claims for consequential compensation whatsoever (however caused) which arise out of or in connection with your use of the Products.

9.3 By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by these terms and conditions.
